General Terms and Conditions

§ 1 General

The following terms and conditions are written in German and can be downloaded and saved by the customer. They can be requested in digital or written form on request. Status: July 2017

§ 2 Validity

(1) All services and offers from Pentecost Tutoring (hereinafter: service provider) are provided exclusively on the basis of these GTC.

(2) Subsidiary agreements are only valid if they are agreed in writing.

(3) Changes and additions to these GTC must also be in writing to be valid.

(4) Any deviating conditions of the client that have not been expressly accepted in writing are non-binding.

§ 3 Services

(1) Offers for services are subject to change and non-binding. Information in advertising texts is not to be regarded as assured properties or guarantees unless otherwise agreed.

(2) The following services are offered:

• Language lessons or help with homework, exams, presentations, etc. in the customer's premises and via the Internet

• Interpreting services

• Translations

• Corrections

(3) Agreements on the time, place and fee for the service are made individually with the respective customer.

(4) The service provider is free to work for other customers as well.

§ 4 Invoices and receipts

(1) The customer will be issued an invoice for the services provided, which must be paid within the period stated in the invoice.

(2) Cash payment against receipt can be agreed. This is issued at the end of the month in which the service was provided.

§ 5 General limitation of liability

Claims for damages arising from the violation of secondary contractual obligations are excluded unless there is intentional or grossly negligent behavior or the violation of an essential contractual obligation or of the body or health of a person. The same applies if compensation for indirect or consequential damage is required. In these cases, any liability is limited to the damage that was foreseeable at the time the contract was concluded and is typical for such cases. Liability under the ProdHG remains unaffected.

§ 6 Place of performance, place of jurisdiction, choice of law

(1) The place of performance and place of jurisdiction is Westerstede in Ammerland if the contractual partner is a merchant or a legal entity under public law.

(2) The contractual relationship is subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods.

§ 7 Severability Clause

If a clause in these terms and conditions is invalid, the validity of the remaining terms and conditions remains unaffected.
